LONDON NEON TERMS AND CONDITIONS

Please read these Terms and Conditions (hereafter "Terms" or "Terms and Conditions") carefully before using or purchasing from the londonneon.co.uk website (hereafter "Site", “Website” or “the Website”)  or interacting with the purchasing system, customer support or other services (hereafter “the Service” or “Service”) operated by London Neon (hereafter "us", "we", or "our").

Your access to and use of the Website and Service is conditional on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and customers (hereafter “you”, “them”, or “they”) who:

*access the images, photos, audio, video and other forms of data or communication (hereafter “Content”); use the Service; and purchase store products, personalized or customized signs, lights, lamps or art (hereafter “Products”) from London Neon via the londonneon.co.uk website, over the phone, email, in person or through any other means whether electronic, digital or otherwise.

By accessing or using the Website, Service, or by purchasing Products you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the terms then you may not access the Website or Service.

Import Duty

Orders to some countries may be subject to import fees/duties and taxes when delivery takes place. This depends on which country you are ordering from and how heavy the LED neon sign is.

Please note that this is standard procedure for any item bought online and is entirely out of our hands - many orders won't be subject to import fees, but for those that are, please be aware that these fees are the responsibility of the customer and are not covered by London Neon. 

Once an order has been confirmed, the customer takes full liability for all postal charges, return shipment costs and resend shipment costs if they refuse to accept a parcel due to import duties or taxes. Shipping costs are non-refundable. Delivery Standard excludes the day of posting and time spent on customs clearance.

Eligibility

To be eligible to use this Website you must be at least 18 years old. If you use londonneon.co.uk on behalf of a company, entity, or organization, you must be an authorized representative with the authority to bind it to these Terms and Conditions (which authority you hereby exercise).

Changes to these Terms and Conditions

We may modify the Terms and Conditions from time to time. When changes are made, we will notify you by making the revised version available on this webpage and indicate at the top of this page the date that revisions were last made. You should revisit these Terms and Conditions on a regular basis as revised versions will be binding on you. Any such modification will be effective upon our posting of new Terms and Conditions. Your continued use of this Website after any posted modification to the Terms and Conditions indicates your acceptance of the modification.

Wholesale Terms and Conditions

These are the terms and conditions (the “Terms”) on which we, London Neon (“We”, “Us” and “Our”) produce and sell any of Our products (the “Products”) to you in your capacity as a retailer or wholesaler, whether you operate your business via a physical retail shop or e-commerce website. 

We may ask you to prove the existence of your business for Us to establish that you are a retailer or wholesaler. This may include, amongst other things, your providing Us with the address or location of your business. 

If We are unable to supply you with any Product(s) ordered or if We are unable to comply with the time scale or volume set out in your Order, We will inform you of this by email as soon as is reasonably practicable upon becoming aware of any such issues. We will not process the Order unless and until you confirm to Us by email that you wish Us to proceed and the details of any changes required to be made to your order. If We are able to, We will offer you the nearest alternative or if you would prefer, We will refund you the total amount that you have paid in respect of the relevant Products as soon as is reasonably practicable, where you have already paid for the Products.

Once your order is received by Us, it will be added to Our workflow system list. We will confirm and accept your Order in writing by replying to your email and sending you an electronic copy invoice (the “Invoice”). The Invoice will confirm the details of your Order, an order number and the amount payable by you in respect of your Order, together with any delivery or other charges applicable to your Order.

Please read London Neon's Terms carefully and ensure that you understand them and check that the details on your order for the Products and in these Terms are complete and accurate before you confirm you place an order for Products. You are responsible for all information provided to Us in relation to the products ordered. We shall not be responsible for any errors or missing information in the details We receive from you.

Website Availability

We reserve the right to modify, update, or discontinue londonneon.co.uk at our sole discretion, at any time, for any or no reason, and without notice or liability.

Product Availability

All London Neon Products are made to order. This includes the Products in the Website shop section. We aim to deliver Your Product within 3-5 weeks for standard orders. We will make every effort to ensure your purchased product reaches you within the stated timeframe, but we make no guarantees, as issues can arise outside our control.

Product and Purchases

If you wish to purchase any product or make use any Service made available through this Website, you may be asked to supply certain relevant information including, but not limited to, your name, email address, delivery address and payment information. For full information on what information we collect and how we use it please see our Privacy Policy.

London Neon reserves the right to change our prices at any time.

London Neon reserves the right to refuse or cancel specific orders at our sole discretion. You will be informed of any such refusal or cancellation within a reasonable timeframe, and a reason for the refusal or cancellation will be provided.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

We reserve the right but are not obligated to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.

We reserve the right to limit the quantities of products or services we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion.

We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations or that any errors in the Service will be corrected.

Artist Collaboration

Products sold under our "Artist Collaboration" are available exclusively online through the website. These products may have limited quantities and are subject to return or exchange only according to our Return Policy. 

London neon will not be responsible for third-party theft of these designs for use elsewhere. 

Design Service

London Neon offers a design service for custom logos which are subject to a non-refundable £10 design fee per revision. Payment is required upfront and in full. If a customer approves the design(s) and proceeds with the sign purchase, London Neon will deduct (each) £10 design fee from the order total.

London Neon reserves the right to refuse certain design requests at our sole discretion. You will be informed of any such refusal within a reasonable timeframe, and a reason for the refusal will be provided.

Online Customizer

Due to the hand-rendered nature of LED neon signs can be subject to slight design variations and discolorations. Variations in colour and design can occur as a result of the computer screen and image resolution. Therefore we can't guarantee that each neon will be 100% the same as presented in our customizer. By purchasing from the online customizer, you acknowledge and accept that the actual design and colour may vary from the computer image. 

London Neon reserves the right to change our prices at any time.

Custom Quotes and Discounts

Unless otherwise stated, all custom quotes and discounts offered to customers are valid for 72 hours and may be subject to change thereafter.

Payment and Invoicing

Shop signs and Products - Payment for all signs and Products ordered through the London Neon online shop is taken at the point of sale via PayPal or by using a major credit card.

Bespoke Custom signs designed by London Neon - Payment is required in full before production can begin. Once you have approved a design, you will receive an invoice via email, which can be paid via Paypal or a major credit card. When payment has been made, your Order will go into production.

Bespoke Custom signs are constructed entirely by hand; therefore, each sign is a 1-of-1 unique design made for the precise purpose and will of the buyer. Therefore, a custom neon sign may not 100% match the design of the mock-up that we sent. Our customers will receive a design proof of their LED neon sign before shipping, where they will have 24 hours to review and make minor adjustments or tweaks where possible and within reason. However, no return or exchange is possible after the customer approves the original mock-up and the order is paid. We encourage our customers to take as much time as they need before ordering their custom LED neon sign. 

Please check the details set out in the Invoice, as We shall not be responsible for any errors or missing information once you confirm the Order. Please quote the Order number in all subsequent correspondence with Us relating to the Order.

The Use of Klarna

In order to offer you Klarna’s payment methods, we may need to pass your personal data in the form of contact and order details to Klarna. Klarna uses this info to assess whether you qualify for their payment methods and to tailor those payment methods for you. Your personal data transferred is processed in line with Klarna’s own privacy notice.

Delivery

Standard and Rush delivery is completed upon the arrival of the Product at the Delivery Location. Delivery of the Product shall be accepted at any time of day.

Any dates quoted for Standard and Rush delivery are approximate only, and the delivery time is not of the essence. London Neon shall not be liable for any delay in delivery of the Product caused by a Force Majeure Event or the Customer's failure to provide London Neon with adequate delivery instructions, documents, licences or authorizations.

On delivery, the Customer shall carry out a thorough inspection of the Product and shall not begin the installation, engage any installers, or incur any further costs or expenses until it has carried out such inspection.

Non Delivery

The quantity of any consignment of Product as recorded by London Neon upon dispatch from London Neon's place of manufacture shall be conclusive evidence of the quantity received by the Customer on delivery unless the Customer can provide conclusive evidence proving the contrary.

London Neon shall not be liable for any non-delivery of the Product unless written notice is given to the carrier and London Neon within 2 days of the date when the Product would in the ordinary course of events have been received.

Any liability of London Neon for non-delivery of the Product shall be limited to replacing the Product within a reasonable time or issuing a credit note against any invoice raised for such Product.

Returns & Refunds

London Neon will accept returns and refunds of faulty Products only. We cannot accept returns due to a change of mind as all our Standard, Personalized, and Custom-made LED neon signs are made-to-order and sent directly into production after payment is confirmed.

• Standard sign- These signs have a pre-determined shape/font/size and price and are available only through our online shop. Example Standard Neon: "Good Vibes Only"
• Personalized sign- These signs have been made using our Online Customizer, available under the "Design Your Own" page. The customer has determined the font/size and price. Example Personalized Neon: "Dave's Bar" 
• Custom-made sign- These signs have been designed by our team or submitted via the "Custom Quote" page. The signs have been made to the customer's exact specifications, such as the style/font/size/wording/colour/backing/extras / etc...

The final resolution for faulty products, including refunds for the cost of the product and/or shipping, is decided on a case-by-case basis and is at the sole discretion of London Neon.

Customers must thoroughly review their invoices before making payment to ensure that the item's specifications are correct and to their satisfaction. Please flag any issues with your order immediately by contacting us at info@londonneon.co.uk.

Returns Procedure

Please get in touch with London Neon directly to let us know which product(s) you wish to return and why.

• Please provide us with photos and videos of the item when you have received it for diagnostic and quality purposes. If you cannot provide both a video and photo(s) of the problem, then our ability to rectify your issue will be limited.
• Once we have received all the required information, we will be in touch to resolve the issue. If a return has been agreed to, please note that the faulty product must be in its original condition that it was received, along with its original packaging, and sent to the return address provided by London Neon.
• The faulty item must be returned for inspection by London Neon within 14 days of the date you received the product. Items sent after the 14-day window may no longer be refundable.
• If a replacement has been agreed to, we will produce and ship the replacement product to you as soon as possible, free of charge.
• We will process the refund immediately if a full or partial refund has been agreed upon.

Damaged in Transit

We recommend opening your London Neon parcel upon delivery. In the unlikely event that your sign has been damaged in transit, London Neon will ensure a resolution.

Damage must be reported within 72 hours of delivery of your London sign to be eligible for a replacement. Damage or faults reported after this time period will follow our general returns and refunds policy and will not be covered under warranty. Note: the delivery date is the courier delivery date which can be found by following the prompts in your tracking email.

If you believe your item has been damaged in transit, please send an email to your info@londonneon.co.uk with the following:

• a clear photo of the damage to the sign,
• a clear photo of the box & any damage to the outer box,
• and a clear photo of the shipping label on the box.

Lost, Missing & Stolen Signs

London Neon takes all necessary care to ensure our signs are delivered safely to our customers. We use a premium express shipping service that requires a signature on delivery. The customer may request to opt-out of the signature on delivery directly through the shipping service once the shipment process has begun. Please be aware that if you choose to opt-out of the signature on the delivery requirement, London Neon will take no responsibility for lost, missing or stolen parcels marked as ‘delivered’ by the shipping service.

Warranty

London Neon indoor Products include a one-year warranty that covers electrical components when used appropriately, *unless otherwise stated. Custom Neon outdoor Products include a 4-month warranty that covers electrical components when used appropriately, *unless otherwise stated.

*The customer must review the product description for detailed information regarding their neon sign purchase. 

Resolution for faulty signs will depend on the fault's source and will be determined between London Neon and You, the purchaser. London Neon will either fix, replace or refund the product.

Any neon sign that has been hardwired by an electrician automatically voids your purchase warranty, as it will be difficult for London Neon to establish a cause. 

Rights

The content, trademarks, artwork and Products for sale on https://londonneon.co.uk/ are the exclusive property of London Neon.

You acknowledge and agree that all ownership, license, intellectual property and other rights and interests in and to the Website and Service, including, without limitation, any LED neon sign designed and/or built-in connection with the Service, together with any image, design, proof or other representation or of a LED neon sign produced by London Neon in connection with the Service shall remain solely with London Neon, unless expressly agreed otherwise, in writing, by London Neon.

You agree not to reproduce, duplicate, copy, or exploit any portion of the Product, use the Service or Products, or access to the Service or Products without express written permission from us.

As part of our Terms and Conditions, our customers warrant that they have appropriate intellectual property rights in any content they create or upload to our servers. Moreover, our customers agree to indemnify and hold harmless London Neon for all liability resulting from any breach of warranties, including the aforementioned intellectual property warranty.

We permit you to use this Website subject to the restrictions in these Terms and Conditions.

Restrictions on Use

You agree that you will not and will not assist or enable others to:

*use londonneon.co.uk to threaten, stalk, defraud, incite, harass, or advocate the harassment of another person, or otherwise interfere with another user's use of londonneon.co.uk; use londonneon.co.uk to submit or transmit spam, chain letters, contests, junk email, pyramid schemes, surveys, or other mass messaging, whether commercial in nature or not; use londonneon.co.uk for promotional or commercial purposes, except as expressly allowed in writing by londonneon.co.uk; use londonneon.co.uk in a manner that may create a conflict of interest; use londonneon.co.uk to promote bigotry or discrimination against protected classes; use londonneon.co.uk to violate any third-party right, including any breach of confidence, copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; use londonneon.co.uk uk to create or promote pornography or illegal content; use londonneon.co.uk in violation of the Terms and Conditions or any applicable law; modify, adapt, appropriate, reproduce, distribute, translate, create derivative works or adaptations of, publicly display, sell, trade, or in any way exploit London Neon’s Products or londonneon.co.uk Content, except as expressly authorised by London Neon; reverse engineer any portion of londonneon.co.uk, except as may be permitted under the law; remove or modify any copyright, trademark or other proprietary rights notice on londonneon.co.uk or on any materials printed or copied off of londonneon.co.uk; use any robot, spider, site search/retrieval application, or other automated device, process or means to access, retrieve, scrape, or index londonneon.co.uk or any londonneon.co.uk Content without permission from londonneon.co.uk; reformat or frame any portion of londonneon.co.uk; take any action that imposes, or may impose in our sole discretion, an unreasonable or disproportionately large load on londonneon.co.uk’s technology infrastructure; attempt to gain unauthorized access to londonneon.co.uk user accounts, computer systems or networks connected to londonneon.co.uk through hacking, password mining or any other means; use londonneon.co.uk or any londonneon.co.uk Content to transmit any computer viruses, worms, defects, Trojan horses or other items of a destructive nature (collectively, "Viruses"); use any device, software or routine that interferes with the proper working of londonneon.co.uk, or otherwise attempt to interfere with the proper working of londonneon.co.uk; make excessive traffic demands; use londonneon.co.uk to violate the security of any computer network, crack passwords or security encryption codes; disrupt or interfere with the security of, or otherwise cause harm to, londonneon.co.uk or londonneon.co.uk Content; remove, circumvent, disable, damage or otherwise interfere with any security-related features of londonneon.co.uk features that prevent or restrict the use or copying of londonneon.co.uk Content, or features that enforce limitations on the use of londonneon.co.uk.

 Third Parties

londonneon.co.uk may include content from and/or links to other websites (each, a "Third Party Site"). We do not control or endorse any Third Party Site, and you agree that we are not responsible for the availability or contents of such Third Party Sites.

Miscellaneous

No agency, partnership, joint venture, or employment is created as a result of the Terms and Conditions, and you do not have any authority to bind us in any respect whatsoever.

We may provide you with notices, including changes to the Terms and Conditions, by email, regular mail or postings on londonneon.co.uk.

The Terms and Conditions contain the entire agreement between you and us regarding the use of londonneon.co.uk and supersede any prior agreement between you and us on the such subject matter. The parties acknowledge that no reliance is placed on any representation made but not expressly contained in these Terms and Conditions.

Any failure on our part to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder.

If any provision of the Terms and Conditions is unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms and Conditions shall otherwise remain in full force and effect and enforceable.

The Terms and Conditions are not assignable, transferable or sublicensable by you except with our prior written consent but may be assigned or transferred by us without restriction. Any assignment attempted to be made in violation of the Terms and Conditions shall be void.

The section titles in the Terms and Conditions are for convenience only and have no legal or contractual effect.
